Article 3. Paragraph 4.The following shall apply to the carriage of dangerous goods by air:
- Convention on International Civil Aviation of 7 December 1944 (Official Journal of the FPRY– International Treaties and Other Agreements 3/1954, 9/1961, 5/62, 11/1962 and Official Journal of the SFRY – International Treaties and Other Agreements 55/1970, 49/1971, 62/1973 and 15/1978) and the Decision on publication of multilateral international treaties the Republic of Croatia is party to pursuant to accession ( Official Gazette – International Treaties 6/94), and
- International Standards and Recommended Practices of the International Civil Aviation Organisation – ICAO): Annex 18 to the Convention on International Civil Aviation – The Safe Transport of Dangerous Goods by Air and ICAO Doc. 9284 AN/905 Technical Instructions for the Safe Transport of Dangerous Goods by Air.
Article 49. Paragraph 1.
- The carriage of dangerous goods by air on national and international flights may be carried out:
- in accordance with the air transport regulations in force in the Republic of Croatia and
- with direct application of International Standards and Recommended Practices of the International Civil Aviation Organisation (ICAO):
- Annex 18 to the Convention on International Civil Aviation – The Safe Transport of Dangerous Goods by Air and
- Technical Instructions for the Safe Transport of Dangerous Goods by Air (ICAO Doc. 9284 AN/905) (hereinafter: Technical Instructions) and published amendments in accordance with Article 38 of the Convention.
Article 50. Paragraph 1.If the safety of aircrafts is compromised, and in the event of accidents and serious incidents of aircrafts related to dangerous goods, the aircraft captain and other participants related to the carriage of dangerous goods must act in the manner described in ICAO Doc. 9481 Emergency Response Guidance for Aircraft Incidents Involving Dangerous Goods. The Civil Aviation Agency must be properly notified about any compromising of aircraft safety, accidents and serious incidents of aircrafts related to dangerous goods.

Article 1. Paragraph 2.This Ordinance shall apply to a legal and natural person who is involved in the organization, preparation, acceptance and transfer of cargo, mail and luggage containing dangerous goods that is intended for transport by air.
Article 6. Paragraph 1.
It is forbidden to transport dangerous goods by air which is not in accordance with the provisions of this Ordinance and Technical Instructions.
ICAO Standards and Recommended PracticesDangerous goods are carried regularly and routinely by air all over the world. To ensure they do not put an aircraft and its occupants at risk there are international Standards which each State, under the provisions of the Chicago Convention, are required to introduce into national legislation. This system ensures governmental control over the carriage of dangerous goods by air and gives world-wide harmonization of safety standards.
Annex 18 to the Convention on international Civil Aviation the Safe Transport of Dangerous Goods by AirAnnex 18 to the Chicago Convention was developed as a response to a demand by Contracting States for an internationally agreed upon set of provisions addressing the transport of dangerous goods by air. These provisions are based upon the Recommendations of the United Nations Committee of Experts on the Transport of Dangerous Goods and the Regulations for the Safe Transport of Radioactive Material of the International Atomic Energy Agency.
All amendments to Annex 18 are approved by the Council following a recommendation from the Dangerous Goods Panel of the Air Navigation Commission and consultation with States.
Annex 18 sets down broad principles but one of the Standards requires that dangerous goods are carried in accordance with the Technical Instructions for the Safe Transport of Dangerous Goods by Air.
Contracting States are required by Annex 18 to have inspection and enforcement procedures to ensure that dangerous goods are being carried in compliance with the requirements.
Technical Instructions for the Safe transport of Dangerous Goods by Air (Doc 9284 AN/905)The Technical Instructions amplify the basic provisions of Annex 18 and contain all the detailed instructions necessary for the safe international transport of dangerous goods by air.
Dangerous goods can be carried safely by air transport providing certain principles are adopted. These principles have been used in developing the Technical Instructions. They are intended to facilitate transport while providing a level of safety such that dangerous goods can be carried without placing an aircraft or its occupants at risk, providing all the requirements are fulfilled.
They try to ensure that should an incident occur it cannot lead to an accident.
Provisions of the Technical Instructions are based on the United Nations Recommendations for Transport of Dangerous Goods and International Atomic Energy Agency Regulations for the Safe Transport of Radioactive Material.
Supplement to the Technical Instructions for the Safe Transport of Dangerous Goods by AirA Supplement to the Technical Instructions provides information on the safe transport of dangerous goods by air that is primarily of interest to States.
Publishing this information in a separate document eliminates from the Technical Instructions material which the average user has neither the need nor the desire to know. The size and complexity of the Technical Instructions is thereby reduced, and its comprehensibility enhanced.
Examples of the subjects dealt with in the Supplement are guidance for the issue of certain exemptions or approvals by States and the reporting of dangerous goods accidents and incidents to ICAO by Contracting States.
Certain dangerous goods, which are forbidden in normal circumstances (identified in Table 3-1 of the Technical Instructions by Special Provision A1, A2, A78 or A106 or by words “Forbidden” for transport on both passenger aircraft and cargo aircraft), may be specifically authorized for air transport by prior approval or exemption issued by appropriate national authorities.
Addendum and Corrigendum to the Technical Instructions for the Safe Transport of Dangerous Goods by Air
The Technical Instructions can also be amended by the ICAO Council, following a recommendation from the Dangerous Goods Panel of the Air Navigation Commission.
Emergency Response Guidance for Aircraft Incidents involving Dangerous Goods (Doc 9481, AN/928)The ICAO Emergency Response Guidance for Aircraft Incidents involving Dangerous Goods (ICAO Doc 9481, AN/928), developed for use by flight crews while in-flight, outlines a series of actions to be taken in the event of a fire or leak. These actions are specific to the type of substance involved and pertain to the environmental situation within an aircraft. Use of this guide is not mandatory, so air carriers may use any other document which provides similar information concerning the dangerous goods on board.
Reference ManualThe International Air Transport Association (IATA) produces a field document commonly used by the operators called the Dangerous Goods Regulations (DGR), it has no legal standing.
The Dangerous Goods Regulations have been developed from the Technical Instructions and the two documents are compatible, although sometimes the Dangerous Goods Regulations are more restrictive than the Technical Instructions.
